Court documents obtained by Us Weekly confirmed that Kate, 42, was arrested on suspicion of assaulting a family or a family member in a previous case in Harris County, Texas, on Tuesday, April 14.
Kate is being held on $35,000 bond ahead of a court hearing on Thursday, April 16.
TMZ reported that an argument broke out between Kate and her estranged husband, Michael, on Tuesday at his home in Texas when they were supposed to exchange their two children. (Kate and Michael have sons Landon, 13, and Logan, 10. Michael is also father to four grown children — Lindsay, Michael Jr., Ali again Cody – from his marriage to his former wife Dina Lohan he also shares a daughter Ashley Horn with ex Kristi Kaufmann Horn.)
According to Kate, Kate punched Michael and gave him a bloody nose during an argument at her home. It is said that he also threw a steak knife, which reportedly bounced on Michael’s chest without hurting him.
Court records obtained by TMZ reveal that Kate was allegedly drunk when police arrested her after the incident. At a bond hearing Tuesday, the judge ordered her to have no contact with Michael at this time and to participate in a breathalyzer test.

The exes have been in a lot of legal trouble since their split in 2015.
In April 2025, Michael was sentenced to nine months in prison for breaching his parole for allegedly assaulting Kate. He received a prison sentence for an alleged parole violation since he pleaded guilty to five counts of drug trafficking in Florida in 2022 after referring people to a recovery center.
When Michael was arrested, Kate broke his silence by telling him Radar Online that he was putting his faith in the US justice system.

Michael served time at the Palm Beach County Detention Center in Florida before being released in October 2025.
“Thank you for getting me out early and being reunited with my boys,” he told TMZ in October. “This should not have happened. It was wrong! As always, there is more to the story than what is being reported. I am just happy to be relieved and sorry for the bad news it has caused my family.”
Michael met Kate following his split from Lindsay’s mother, Dina, in 2005. Michael’s spokesperson confirmed that Us that he and Kate tied the knot in October 2014.
